Brain Surge

Brain Surge is a free-to-play, offline trivia and quiz mobile game developed and published by FunMindo, an indie game studio based in India. The Game is available on the Google Play Store for Android devices.

By downloading, installing, accessing, or playing Brain Surge, you confirm that you:

• If you are under the age of majority in your jurisdiction, you must use the Game with the consent or supervision of a parent or legal guardian;
• Have the legal capacity to enter into a binding agreement in your jurisdiction;
• Have read and agree to these Terms in their entirety; and
• Accept our Privacy Policy, which is incorporated into these Terms by reference.

If you do not meet these requirements or do not agree to these Terms, you must not install or use the Game.

Subject to your compliance with these Terms, FunMindo grants you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and use Brain Surge on Android devices you own or control, solely for your personal, non-commercial entertainment.

This license does not allow you to:

• Copy, modify, distribute, sell, or sublicense any part of the Game;
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Game;
• Create derivative works based on the Game or its content;
• Remove, obscure, or alter any copyright, trademark, or other proprietary notices;
• Use the Game for any commercial purpose or for the benefit of any third party;
• Use any automated tool, bot, script, or hack to interact with the Game;
• Exploit bugs or glitches intentionally for personal gain.

All rights not expressly granted in these Terms are reserved by FunMindo.

Question Database. Brain Surge contains a built-in question database across categories including Animals, Science, Geography, Food & Cooking, Music, History, Sports, Technology, Literature, Maths & Logic, Movies, and more. Questions are provided for educational and entertainment purposes only. While we strive for accuracy, we make no guarantee that every answer or fact is free from error.

Categories & Unlocks. Two categories — Animals and Science — are unlocked by default. Additional categories are unlocked by earning XP through gameplay. No purchase is required to unlock any category. Special game modes (Sharp and Blitz) within each category may require spending in-game XP coins earned through normal play.

Daily Question of the Day. One bonus question is available per calendar day. Completion resets at midnight. This is an optional feature with no penalty for skipping.

Login Streaks. Daily login streaks are tracked locally on your device. A Streak Shield (watchable via rewarded ad) may protect one missed day. Streaks and all progress are stored on your device only and will be lost if you clear app data or uninstall the Game.

Lifelines. Each game session includes three lifelines (50/50, Skip, Extra Life). Each lifeline may be used once for free per session. After the free use, it becomes an ad-supported lifeline — watching a short rewarded video ad restores that lifeline for the current session.

XP & Ranks. XP is earned by answering questions correctly, maintaining streaks, and using the Double XP feature (via rewarded ad). Ranks are cosmetic only and confer no real-world value or monetary benefit.

Themes & Customisation. Decorative visual themes may be unlocked through XP or rewarded ads. Themes are cosmetic and do not affect gameplay.

Content Updates. We may add, modify, or remove questions, categories, features, or in-game content at any time without prior notice.

Brain Surge is free to play and is supported by advertisements delivered by Google AdMob. By using the Game, you consent to the display of advertisements as described below.

Ad personalisation is handled by Google AdMob. You can opt out of personalised ads via Android Settings → Google → Ads → Opt out of Ads Personalisation.

Brain Surge does not offer any in-app purchases, premium tiers, paid content, subscriptions, or virtual currency available for real money. All gameplay content — including all quiz categories, lifelines, and XP rewards — is obtainable through normal gameplay or by watching optional rewarded ads. There is no way to spend real money inside the Game.

Brain Surge, including its name, logo, visual design, UI elements, question content, game mechanics, mascot character ("Spark"), sound effects, music, and all related materials, is the exclusive intellectual property of FunMindo and is protected by applicable copyright, trademark, and other intellectual property laws in India and internationally.

You are not permitted to use FunMindo's name, logo, or any Brain Surge branding without our prior written consent. Nothing in these Terms transfers any intellectual property rights to you.

The trivia question content in Brain Surge is original or based on publicly known facts. If you believe any question content infringes your intellectual property, please contact us at funmindostudio@gmail.com.

While Brain Surge is a single-player offline game with no online features, you agree to use the Game only for lawful, personal purposes. You must not:

• Use the Game in any way that violates applicable laws or regulations;
• Attempt to cheat, hack, or manipulate the Game's scoring or XP systems;
• Use automated scripts or tools to simulate gameplay;
• Distribute modified versions of the Game or its content;
• Use the Game to defame, harass, or harm any person or entity;
• Attempt to circumvent or disable advertisements in a manner that violates applicable law.

FunMindo reserves the right to update these Terms to address any misuse as the Game evolves.

All game progress — including your score history, XP, unlocked categories, rank, daily streaks, lifeline states, and settings — is stored locally on your device. FunMindo does not maintain any cloud backup or server-side save system.

• Data loss on uninstall: Uninstalling the Game will permanently delete all local game data. This cannot be undone by FunMindo.
• Data loss on device change: Moving to a new device will result in loss of game progress, as no transfer mechanism exists.
• Data loss on app data clear: Clearing the app's data in Android settings will reset all progress.

FunMindo is not responsible for any loss of game progress arising from the above scenarios, device failure, OS updates, or any other cause. We strongly encourage you to be aware of this limitation.

Brain Surge is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied. To the maximum extent permitted under applicable law, FunMindo disclaims all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose;
• Warranties that the Game will be error-free, uninterrupted, or free from bugs;
• Warranties regarding the accuracy or completeness of trivia question content;
• Warranties that defects will be corrected, or that the Game is free of viruses or other harmful components.

Your use of the Game is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

To the maximum extent permitted by applicable law, FunMindo and its founders, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, Brain Surge. This includes, without limitation:

• Loss of game progress, scores, XP, ranks, or streaks;
• Device malfunction, battery drain, or data charges incurred;
• Any damage resulting from third-party advertisements served by Google AdMob;
• Loss of data due to uninstallation, device failure, or OS changes;
• Any reliance placed on trivia content presented in the Game.

To the maximum extent permitted by law, FunMindo's total liability arising from the Game shall not exceed the amount paid by you for the Game during the twelve months preceding the claim. Since Brain Surge is provided free of charge, this amount will typically be ₹0.

Brain Surge integrates the following third-party services. By using the Game, you also agree to their applicable terms and privacy policies:

FunMindo is not responsible for the privacy practices, terms, or content of these third-party services. We encourage you to review their policies independently.

Game changes: FunMindo reserves the right to update, modify, suspend, or discontinue Brain Surge (or any part of it) at any time, with or without notice. We may add new features, remove existing ones, change gameplay mechanics, or update question content at our sole discretion.

Terms changes: We may revise these Terms at any time. Updated Terms will be posted at funmindo.github.io/brain-surge-terms/ with a revised "Last Updated" date. Continued use of the Game after any change constitutes acceptance of the updated Terms.

For significant changes, we will endeavour to notify users through an in-game notice or via the Google Play Store update description.

These Terms remain in effect until terminated. Your rights under these Terms terminate automatically and without notice if you fail to comply with any provision herein.

FunMindo may also discontinue the Game or stop distributing it on the Google Play Store at any time. Upon termination for any reason:

• All licenses granted to you under these Terms immediately cease;
• You must stop using the Game and delete it from your devices.

Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, disclaimers, and governing law) will continue to apply.

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and other applicable Indian statutes.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Game shall be subject to the exclusive jurisdiction of the competent courts located in India. You consent to personal jurisdiction in such courts and waive any objection to such venue.

Before initiating any formal legal proceedings, we encourage you to first contact us at funmindostudio@gmail.com to resolve the matter informally. We will make reasonable efforts to address your concern within 30 days.

In accordance with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 (DPDPA), the Grievance Officer details are provided below:

We take all grievances seriously. If you are not satisfied with our response, you may approach the appropriate consumer forum or the Data Protection Board of India.

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and FunMindo regarding your use of Brain Surge, and supersede all prior agreements or understandings.

Severability. If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

No Waiver. FunMindo's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision in the future.

Assignment. You may not assign or transfer these Terms or any rights under them without FunMindo's prior written consent. FunMindo may assign these Terms without restriction.

Language. These Terms are written in English. In the event of any conflict with a translation, the English version shall prevail.
